- These terms and conditions govern the rights and obligations of the contracting parties arising in connection with the ordering of photographic services provided by Lucie Šimonovská, ICO 14121204, with registered office at V jezírkách 1540/6, Prague 11 - Chodov, 14900 (hereinafter referred to as the "photographer").

2. Ordering
- The date, time, and type of photo shoot are arranged by phone or email.
- By confirming the order by email or by phone, the client agrees to the terms and conditions for the provision of photographic services.
3. Payment and cancellation terms
- The price is payable on the day of the photo shoot, unless otherwise agreed with the photographer.
- For payment by bank transfer on invoice, the final photos are not provided until the invoiced amount has been credited to the account.
- If you order all photos in full resolution, a fee of 1000 CZK will be charged. The photos will be delivered after the amount has been credited to the account.
- You can cancel your booking free of charge up to 48 hours before the start of the photo shoot. If you cancel or reschedule your booking to another day less than 48 hours before the start of the photo shoot, a fee of 500 CZK will be charged to cover the time the studio was blocked in vain.
4. Photo Shoot Process
- Please keep to the photography time you have booked. Entering the studio before the agreed time is not possible.
- The maximum length of the photo shoot is specified in the package price list and cannot be extended in any way without an agreement with the photographer.
- A client’s late arrival is not a reason to extend the scheduled photography time.
- If the client is late, it may not be possible to take all the photos included in the package.
- If, within the allotted time (according to the chosen package), we are unable to take a sufficient number of photographs due to the child’s lack of cooperation, this cannot be attributed to the photographer. If we are unable to take any photographs at all, I charge 1000 CZK per hour for studio operation and time spent.
5. Selection of photos for retouching
- The client selects the photos from watermarked previews. A link to the previews is sent by email within 3 working days.
- The preview photos are intended solely for selecting images for retouching – they are in low resolution, watermarked, and under Copyright Act No. 121/2000 Coll. it is forbidden to further edit or use these photos in any way without the operator’s written consent.
- Photo retouching beyond the package: 300 CZK/retouch of one photo.
6. Delivery of Photographs and Delivery Period
- Once the client has selected the photos for retouching and sent their selection by email (according to the chosen package), the processing time for the photographs begins.
- The delivery time varies depending on the selected photography services (2–4 weeks).
- The completed order will be delivered to the client electronically via a link for downloading the photos from the storage.
- The finished photos can be downloaded for a period of 3 months. After that, the photos will be removed from storage. If the client does not download them within 3 months, the photos can be retrieved again for a fee of 300 CZK.
- In the event of illness, vacation, or other operational difficulties, the delivery period may be proportionally extended. If this situation arises, you will be informed.
- The photographs are delivered in full resolution in JPG format.
- If you are interested in the original RAW files, you can purchase them for a fee of 3000 CZK.
- You can have your photos ready in express mode within 24 hours for an extra charge of 200 CZK per photo.
7. Backups and Copyright
- All photographs are protected by copyright and remain the property of the photographer. The client is granted a license for personal use of the photographs.
- The photographs may be used by the photographer for marketing purposes (portfolio, social media), unless agreed otherwise in writing. If you do not agree with the publication of the photographs, you must notify this in writing by email.
- The client is not authorized to further sell, modify, or use the photographs for commercial purposes.
- The client has been informed of the recommendation to back up data in multiple locations and storage devices. The photographer is responsible for keeping backups of the selected and retouched images for 1 year from the date of the shoot. All other data are deleted after the order has been delivered and approved.
8. Cancellation and rescheduling
- A complaint can only be made about technically defective photographs.
- Dissatisfaction with one’s own appearance cannot be influenced by us in any way and is not a valid reason for a complaint.
- A money-back guarantee is available in case of dissatisfaction, for 100% of the amount paid. This situation must be reported after viewing the photo previews, not upon delivery of the retouched photos.
- By submitting a selection of photos for retouching, the client agrees to the processing of the photos without the possibility of complaint.
- By agreeing to these terms and conditions, you acknowledge the author’s style and manner of processing, and therefore it cannot be subject to complaint afterwards.
9. Liability for Damages
- When photographing children and animals, the cooperation of parents and pet owners is required in terms of safety and supervision, so that the studio equipment is not damaged.
- In the event of damage, theft or destruction of technical equipment and props caused by the client, the operator has the right to claim compensation for damages from the client, up to the amount of the purchase price.
10. Final Provisions
- These terms and conditions take effect on 1 January 2026 and remain valid until revoked.
- The photographer reserves the right to change these terms at any time. Any changes do not affect contracts that have already been concluded.
